What Is a Competent Person?

A competent person is someone with the training, experience, knowledge, and other necessary qualities to assist you properly with health and safety management. You can appoint someone internally or use an external provider – the choice is yours. However, consider the following:

  • The level of competence required depends on the complexity of your business activities.
  • Your competent person must be able to advise you on your legal duties and the actions needed to comply.
  • They should also advise on industry best practices, typically set out in HSE guidance notes. These are often used as benchmarks in court – failure to follow them can result in substantial fines.
  • You are required to consult health and safety representatives on your arrangements for competent help.

Your competent person must:

  • Advise on safe systems of work.
  • Ensure controls identified in your risk assessments are implemented and monitored.
  • Support the monitoring of your risk control measures and help investigate incidents to prevent recurrence.
